中国特色“分层式”行政问责模式:创新、不足与完善

Hierarchical model of administrative accountability with Chinese characteristics:innovation,deficiency and improvement

监察问责具有行政外部问责之功能,与行政内部问责具有共同的责任基础,构成了中国特色的“分层式”行政问责模式。然而,该模式在实践运行中存在着制度虚化、协同性不足、适用混乱等问题。对此,应当确立行政问责的法治化路径,加快制定《行政问责法》,区分监察外部问责与行政内部问责,明确行政问责与政务处分、党内问责的界限,就问责对象、问责主体、问责事由以及责任承担方式等做出具体规定,构建独立的行政问责制度体系。

Supervisory accountability together with administrative internal accountability constitutes a“hierarchical”administrative accountability model with Chinese characteristics.However,in practice,this model suffers from institutional deficiency,incoordination and overuse.In this regard,we should establish the rule of law for administrative accountability by accelerating the formulation of the Administrative Accountability Law,distinguishing between external accountability and internal accountability,and mark the boundaries among administrative accountability,administrative discipline and inner-party accountability.In order to develop an independent administrative accountability system,we should speed up the legislation of the administrative accountability by making specific provisions on the objects,subjects,causes of accountability and the model of responsibility.
