涉美追逃中的异地追诉问题研究

在我国尚未与美国签订引渡条约的背景下,异地追诉对我国涉美追逃工作具有重要意义。异地追诉有稳定的国内法基础和国际司法合作平台。实施异地追诉需要研究和掌握美国刑事法律、美国移民法律以及美国处理国际刑事司法协助的规定。应借助现有的中美反腐司法合作平台,加强对美国相关法律的研究、提高部门间的协作能力,不断提升中美刑事司法合作的水平,构建和优化以中美司法合作平台为着力点的异地追诉合作方式。

The United States is the main destination of Chinese fugitives and illegal assets.Foreign Prosecution is an effective alternative measure to extradition and does not presuppose an extradition treaty.To carry out prosecutions involving the United States,it is necessary to study and master the criminal law,the immigration law,and the regulations on handling international criminal judicial assistance in the USA.The existing Sino-US anti-corruption judicial cooperation platform should be used to strengthen the research on relevant U.S.laws,improve inter-departmental collaboration capabilities,and continuously improve the level of Sino-US criminal judicial cooperation,to build and optimize the Sino-US judicial cooperation platform.
