认罪认罚视域下企业合规的程序激励体系构建 被引量:14

摘要 刑事诉讼中的认罪认罚从宽与企业管理中的合规在目的、手段、功能上具有高度的融通性,但实践中两者却在不同的轨道上运行,呈现“碎片式”的表达。整合认罪认罚与刑事合规的程序激励因子,将赋予企业合规以及认罪认罚更为丰富的内涵,进而形成新的制度活力。认罪认罚视域下企业合规的程序激励体系,应选择正向激励,充分发挥合规计划的效力,将合规风险的披露嵌入认罪认罚;保障律师对合规业务的充分参与,实现对被追诉人权利的保护。具体目标与方案包括强制手段的轻缓化、起诉的分流、便利诉讼程序的选择等。 The plea bargaining of the criminal proceedings shares highly compatibility with the compliance of corporate management in the goals,tools and functions.The two systems,however,run on different tracks,with the fragment expression.With integration of procedural incentive factor of plea bargaining and criminal compliance,the corporate compliance and plea bargaining are able to be given more abundant connotation.The procedural incentive system of corporate compliance in perspective of guilty plea and punishment should take the positive incentive into consideration to bring compliance program affection into play.The specific programs include the leniency of compulsory measures,distribution of prosecution,and the selection of convenient litigation procedure.
