Research on the Recognition Rules of Husband and Wife’s Joint Debt

目前,我国关于夫妻共同债务的认定和适用规则等规定不够明确。文章从夫妻共同债务认定的适用困境出发,根据现行法律、司法解释,对认定夫妻共同债务的共债共签规则、家事代理规则、用途规则和合意规则等内容进行比较分析,提出在夫妻共同债务认定规则适用上较为合理可行的方法。

At present,China's provisions on the identification and application rules of husband and wife’s joint debt are not clear enough.Starting from the application dilemma of the recognition of husband and wife's joint debt,according to the current law and judicial interpretation,this paper compares and analyzes the joint debt signing rules,family agency rules,use rules and agreement rules,and then puts forward a more reasonable and feasible method for the application of the recognition rules of husband and wife’s joint debt.
