摘要 对于职务发明权利归属,纵观世界各国,主要存在“厚雇主主义”和“厚雇员主义”两大模式。重构职务发明权利归属制度,根据投资者划分职务发明类型和分配权利,并通过分权制衡保障发明人获得合理利益的权利适更有利于激发发明人创造的积极性。本文基于我国专利发展现状,根据职务发明专利权归属制度效率与公平的价值目标及其实现机制,提出了重构我国职务发明专利权归属制度的立法若干建议。 Regarding the ownership of employee invention rights,there are mainly two modes of“pro-employers doctrine”and“proemployee doctrine”across the world.Reconstructing the ownership system,dividing employee invention types and distribution rights according to investors,and ensuring the legitimate benefits of the inventors through decentralized checks and balances is more conducive to stimulating inventors'enthusiasm for creation.Based on the present situation of patent development in China and the requirements of efficiency and fairness of the attribution system of employee invention patent rights and its realization mechanism,this paper puts forward several legislative suggestions for restructuring the attribution system of employee invention patent rights in China.
