摘要
《海上交通安全法》于2021年4月29日通过修订,并于9月1日起正式施行。在修订过程中,对目前行之有效、科学合理的海上交通管理法律规范予以继承、沿用;对经实践检验过的,在海事管理过程中已经非常成熟的理论和经验坚决地拿来使用;对现行海上交通安全法律中不适应现实情况的规定予以修改完善;针对海上交通安全管理中出现的新情况、新问题,作出有针对性的新规定;对已经不适应社会发展需要的海上交通安全法律规定予以废止;对暂时不宜规定的不予规定,为实践发展留下必要的法律空间。
The new amendments to the Maritime Traffic Safety Law of the People’s Republic of China was adopted on April 29,2021,and officially implemented on September 1.As far as the amendments are concerned,the currently effective and scientific maritime traffic management laws and regulations have been inherited and followed;theories and experiences that have been tested by practice and have become quite mature in maritime administration have been used directly;those provisions that do not adapt to the actual situation have been revised;new provisions in response to new circumstances and problems arising in maritime administration have been added;provisions that no longer meet the needs of social development have been abolished;no revisions have been made on what is not suitable for the time being,leaving necessary space in the legal perspective for the development of practice.
