海事紧急救助涉及商业费用索赔主体的研究

Research on Claim Subject of Maritime Emergency Related Commercial Charge

随着海洋经济的快速发展,海上运输作业日益活跃,险情事故难以避免。在海上险情紧急救助工作中,存在商业救助费用索赔因关系多方利益、索赔主体不明确等问题,救助方得不到应有补偿,已影响了搜救组织、协调工作,不利于社会救助力量的健康发展。通过对救助费用索赔主体案例的分析,探讨搜救中心作为涉及商业费用索赔主体的可行性,并提出相关建议。

With the rapid development of the marine economy,maritime transportation is becoming more and more active,and accidents are inevitable.In maritime emergent rescue,as the claims for commercial rescue expenses are related to the interests of multi-parties,and the subject of the claim is not clear,the rescue providers cannot get due compensation,which has affected the organization and coordination of the search and rescue,and may impair the sound development of social rescue forces.In order to find a solution for this issue,the author studies the subject for the claims.
