国际贸易知识产权数字壁垒研究

Research on Intellectual Property Digital Barriers in International Trade

文章基于国际贸易中恶名市场名单制度及固化知识产权数字壁垒的国际规则发展历程与特征,分析了这两类知识产权数字壁垒产生的原因,及其引起的发达国家滥用知识产权专有权、强化其数字经济优势、推行贸易保护主义的结果。通过梳理知识产权数字壁垒产生缘由,得出了国际贸易中的知识产权数字壁垒加大了发展中国家知识产权保护压力,削弱了发展中国家相关企业对外贸易竞争力以及加剧了发展中国家数字技术鸿沟的结论。在此基础上提出了中国应对知识产权数字壁垒的政策建议,认为在国家层面应加大知识产权制度改革并积极参与国际相关规则的制定,在行业层面应加大反垄断调查及知识产权诉讼,在企业层面应加大知识产权技术创新并完善知识产权保护机制,以期更好地完善中国知识产权数字壁垒应对制度。

In this paper,based on the notorious market list system in international trade and the development process and charact-eristics of international rules to solidify intellectual property barriers,the causes of these two types of intellectual property barriers are analyzed,and it is concluded that they are the result of developed countries abusing the exclusive right of intellectual property,strength-ening their advantages of digital economy and promoting trade protectionism.After the reasons for the emergence of intellectual property digital barriers are sorted out,it is concluded that intellectual property barriers in international trade has increased the pressure on the protection of national intellectual property rights,weakened the foreign trade competitiveness of relevant enterprises in developing count-ries,and aggravated the digital technology gap in developing countries.On this basis,policy suggestions of China on dealing with intelle-ctual property barriers are put forward,it is considered that at the national level,we should strengthen the reform of the intellectual pro-perty system and actively participate in the formulation of relevant international rules,at the industry level,we should increase antitrust investigation and intellectual property litigation,at the enterprise level,we should increase intellectual property technology innovation and improve the intellectual property protection mechanism,so as to better perfect the intellectual property barrier response system of China.
