摘要
作为主要的环境问题,近年来城市生活垃圾污染问题不断加剧,且多重因素的叠加导致城市生活垃圾产出量呈爆炸式增长,污染防治形势愈加严峻。受生活垃圾处置重视程度不足、城市规划不当、污染防治不力、邻避事件频现等因素的影响,城市生活垃圾处置中存在选址和用地紧张的突出问题。现阶段,城市生活垃圾处置项目建设还处于发展升级的进程中,未来一段时期选址和用地问题会更加凸显,打破“属地”原则,实行城市生活垃圾跨区域集中处置具有现实迫切性。鉴于生活垃圾跨区域集中处置中仍存在不少阻碍因素,应通过法律机制的构建为生活垃圾跨区域集中处置提供法律保障。
As a major environmental problem,in recent years,the pollution of domestic waste has been increasingly aggravated and the superposition of multiple factors has caused the explosive growth of domestic waste output.The situation of pollution prevention and control has become badly serious.Due to the insufficient attention paid to the disposal of domestic waste,improper urban planning,ineffective pollution prevention and control,NIMBY effect and other factors,there are prominent problems of site selection and land shortage in the disposal of domestic waste.At present,the construction of domestic waste disposal project is still in the process of developing and upgrading,and the problem of site selection and land use will become more prominent in the future.Therefore,it is urgent to break the principle of“dependency”and carry out cross-regional centralized disposal of domestic waste.Given that there are still many obstacles in the cross-regional centralized disposal of domestic waste,the construction of legal mechanism should provide legal guarantee for it.
