突发疫情信息公开制度研究

Study on Information Disclosure System of Pandemic Outbreak

依法开展疫情防控是依法治国的必然要求,公开疫情信息是依法防控的应有之意。基于突发疫情可能迅速传播的特性及尽早公开疫情信息确实有助于疫情防控的事实,有必要在现有传染病信息公开制度的基础上,不断完善突发疫情信息公开制度,既应准确定义“突发疫情”的概念,也应明确突发疫情信息所包含的具体内容;在政府承担突发疫情信息公开主体责任的基础上,可考虑引入突发疫情信息吹哨人制度并加以规范,以弥补现行仅由政府公开疫情信息制度的诸多不足、完善我国的突发疫情防控立法。

Pandemic prevention and control in accordance with the law is an inevitable requirement for the rule of law,and disclosing pandemic information is the due meaning of law-based prevention and control.In view of the characteristics of rapid spread of pandemic outbreak and the fact that early disclosure of pandemic information is really helpful to pandemic prevention and control,it is necessary to constantly improve the information disclosure system of pandemic outbreak on the basis of the existing information disclosure system of infectious diseases.The concept of pandemic outbreak should be defined accurately,and the specific content of pandemic outbreak information should be clarified.On the basis of the government assuming the main responsibility of disclosing the information of pandemic outbreak,the whistleblower system of pandemic information can be introduced and standardized,so as to make up for the shortcomings of the current system of disclosing the information of pandemic by the government and improve the legislation of pandemic prevention and control in China.
