摘要
本文分析了错误出生之侵权损害赔偿责任的构成要件与损害赔偿的范围,认为错误出生案中至关重要的是损害的判定,惟有深入剖析错误出生之诉中损害的本质,才能为解决此类纠纷提供正确的法律适用方案。
This paper analyzes the constitutive elements and compensation scope of wrongful birth tort liability,and argues that the most important issue in wrongful birth is the determination of damages,and only by deeply analyzing the nature of damages in wrongful birth lawsuits can it provide a correct legal application scheme for solving such disputes.
