摘要
新冠肺炎疫情及防疫管控措施引致部分房屋租赁合同的履行陷入僵局、无法严守——承租人要求变更或者解除合同,而出租人要求对方依约履行并承担违约责任。对此当梳理考察我国现行法律政策和有关司法实务,借鉴域外法的经验,厘清新冠肺炎疫情及因疫情引发的防疫管控措施的法律定性,把握不可抗力和情势变更的适用规则,在合同中引入房屋租赁中断保险条款,会对破解新该合同的履行困境具有积极意义。
As a result of COVID-19 and its prevention and control measures,the implementation of some housing lease contracts has been stuck:the lessee requires to change or terminate the contract,while the lessor requires the other party to perform the contract and bear the liability for breach of contract.In view of this,we should examine and sort out current legal policies and relevant judicial practice in China,draw lessons from the experiences of the extraterritorial laws,clarify COVID-19 outbreak and legal qualitative of pandemic prevention and control measures,grasp application rules of force majeure and changed circumstances,introduce house lease interruption insurance clause into the contract,which will have positive significance to break the dilemma for the implementation of the contract.
