村规民约在当代乡村治理中起到不可替代的作用。但面对着社会的转型,村规民约发生较大的变化,秩序功能不断弱化。在全面依法治国背景下,重构村规民约的规范功能对推动乡村法治进程具有非常重要的意义和价值。村规民约的重构过程一方面要制定出一个与乡村社会发展相适应、与国家法治相契合的配套制度;另一方面要实现公共权力的再生产和国家补给。

The village rules and regulations play an irreplaceable role in the contemporary rural governance.But in the face of social transformation,the village rules and conventions have changed greatly,and the function of order has been weakened.Under the background of comprehensive rule of law,it is of great significance and value to reconstruct the normative function of village rules and conventions to promote the process of rural rule of law.In the process of remolding the village rules and conventions,on the one hand,a supporting system should be formulated to be compatible with the rural social development and the national rule of law.On the other hand,the reproduction of public power and state supply should be realized.
