国防知识产权交易创新发展体系构建及制度研究

The construction and system of innovative development of national defense intellectual property transaction

国防知识产权作为国防科技创新的重要成果,不仅服务于国防安全建设,而且蕴含着巨大的经济价值。然而,不完全竞争、信息不对称,以及国防科技成果的公共产品特性,使得价格机制、供求机制和竞争机制无法有效发挥作用。由于长期受到计划经济体制的影响,市场竞争机制尚未完全建立,中介服务体系不完善,权利归属与利益分配不合理,当前中国国防知识产权交易水平不能完全适应经济社会的发展需求。因此,必须创新国防知识产权交易的方式方法,加强政府整体规划与布局,提高市场交易效率,构建第三方服务体系,优化利益分配方式,保障国防知识产权交易顺利进行,促进国防知识产权经济价值的有效实现。

As an important achievement of national defense science and technology innovation,national defense intellectual property not only serves national defense security construction,but also contains huge economic value.However,incomplete competition,information asymmetry and the characteristics of public goods of national defense scientific and technological achievements make the price mechanism,supply and demand mechanism and competition mechanism unable to play an effective role.Due to the long-term influence of the planned economy system,the market competition mechanism has not been completely established,the intermediary service system is not perfect,the ownership of rights and the distribution of interests is not reasonable,the current level of China's defense intellectual property transactions can not fully meet the needs of economic and social development.,therefore,must be the means of innovation for national defense intellectual property rights trading,promoting the construction of national defense intellectual property transaction management system,strengthen the government overall planning and layout,improve the efficiency of market transactions,build a third-party service system,optimizing the allocation of interests,safeguarding the smooth progress of the national defense intellectual property trade promote economic value to the effective implementation of national defense intellectual property rights.
