农村环境治理法治化的现实困境与路径优化

The Realistic Dilemma and Path Optimization of Legalization of Rural Environmental Governance

农村环境治理是国家治理现代化过程中基层的具体实践,对我国推进乡村振兴战略、美丽乡村建设具有现实意义。农村环境治理法治化依托基层法治建设重塑了传统环境治理模式,开创了新型环境治理路径,是在法治轨道上推进国家治理现代化的重要表现。但在农村环境治理法治化实践中,立法、执法、司法、守法等方面均存在问题。需要从构建农村环境保护法律体系、完善农村执法环境、拓宽农村环境司法渠道、培育多主体环境法治意识等路径进行优化。

Rural environmental governance is a concrete practice at the grass-roots level in the process of national governance modernization,which is of practical significance to the realization of rural revitalization and the construction of beautiful villages in China.The legalization of rural environmental governance has reshaped the traditional model of environmental governance and created a new path of environmental governance by relying on the basic legal construction,which is an important manifestation of promoting the modernization of national governance on the track of rule of law.From the perspective of the practice of legalization of rural environmental governance,it is mainly manifested in the difficulties in legislation,law enforcement,judicature and law-abiding.The paper promotes the improvement of legalization of Rural Environmental Governance by improving the rural environmental protection legal system,standardizing the rural law enforcement environment,broadening the rural environmental justice channels and cultivating the multi-subject legal awareness.
