厨余垃圾处理收费制度的困境及化解--以《反食品浪费法》出台为背景 被引量:1

摘要 《反食品浪费法》第7条第4款规定,餐饮服务提供者可以对造成明显食品浪费的消费者收取处理厨余垃圾的相应费用。该制度将反对个人食品浪费从以往道德谴责层面提升至法律规制层面,有助于社会公众食品节约理念的形成。但该制度存在制度冲突及权利性质不明的理论问题,同时存在“浪费”难以界定、收费标准不明确以及缺乏可实施性等实践障碍。亟需通过合理解释强化公众接受,在明确标准的前提下逐步实施,并辅之以普法宣传使之深入人心。 Article 7(4)of the Anti-Food Waste Law stipulates that catering service providers may charge consumers who cause obvious food waste to deal with food waste.This system raises the level of opposition to personal food waste from the level of moral condemnation to the level of legal regulation,and contributes to the formation of the public's food conservation concept.However,the system has theoretical problems such as system conflicts and the unclear nature of rights.At the same time,there are practical obstacles such as difficulty in defining"waste",unclear charging standards,and lack of implementability.It is urgent to strengthen public acceptance through reasonable explanations,gradually implement them under the premise of clear standards,and supplement them with law popularization to make them deeply rooted in the hearts of the people.
