数字经济时代企业数据权益保护研究

Research on the Protection of Enterprise Data Rights and Interests in the Digital Economy Era

[目的/意义]数据作为数字经济时代的重要资源,十四五规划中提出要“建立健全数据要素市场规则”,而企业作为数字经济中最活跃的主体,研究企业数据保护有助于推动企业数据的流通与应用,推动数字经济快速发展。[方法/过程]该文研究企业数据权益的特性、保护正当性、保护基本原则,分析现行企业数据权益保护模式,以知识产权保护模式为视角对企业数据权益保护进行可行性分析,并给出了将企业数据纳入到知识产权保护体系之内的具体框架及建议。[结果/结论]企业数据权益具有保护的正当性,现有保护模式中均存在不足。对企业数据与知识产权客体共性、二者制度功能一致性及知识产权制度体系发展趋势等进行分析,不难发现在知识产权制度体系内构建企业数据新型知识产权与场景化保护模式有助于解决企业数据保护难题。

[Purpose/Significance]Data is an important resource in the Digital Economy Era.In the fourteenth-five year plan,it is proposed to"establish and improve the market rules of data elements".As the most active subject in the Digital Economy,the research on enterprise data protection helps to promote the circulation and application of enterprise data and promote the rapid development of the Digital Economy.[Method/Process]This paper studies the characteristics,protect legitimacy and basic principles of enterprise data rights and interests,analyzes the current protection mode of enterprise data rights and interests,analyzes the feasibility of enterprise data rights and interests protection from the perspective of intellectual property protection mode,then gives the specific framework and suggestions of bringing enterprise data into the intellectual property protection system.[Result/Conclusion]The protection of enterprise data rights and interests is legitimate,and the existing protection models are insufficient.By analyzing the commonness of the object of enterprise data and intellectual property,the consistency of their system functions,and the development trend of intellectual property system,it is not difficult to find that the construction of new kinds of intellectual property and scene protection mode of enterprise data within the intellectual property system is helpful to solve the problem of enterprise data protection.
