法伦理视阈的“和平”理念探究

The Concept of"Peace"from the Perspective of Law Ethics

借鉴和平学成果,可将“和平”引入法伦理视阈,这里的和平意指不同法律主体之间的非害共生状态。和平理念在法律意识中经过“个体法意识、群体法意识、整体法意识”三个环节,从分散走向集中;在法律规范领域表征为“纵向和平、横向和平和交叉和平”三种逻辑类型;在司法实践领域,则体现为以智慧和良知解决争议。将和平作为法伦理的基础理念予以重视,对于“德法共治”具有重要价值,既有助于化解法律纠纷,维护法律秩序,也有助于弘扬中国传统文化中的“无讼”理念,提升现实世界的“伦理精神”,促进整体至善与个体至善的有机统一。

Drawing on the research results of peace studies,this paper introduces"peace"into legal ethics,where peace means the non-harmful symbiosis among different legal subjects.The concept of peace is represented in individual legal consciousness,collective legal consciousness and overall legal consciousness.In the field of legal norms,it is embodied in three types:vertical peace,horizontal peace and cross peace.In the field of judicial practice,it is reflected in the settlement of disputes with wisdom and conscience.Adhering to peace is of great value to the state governance.It helps to prevent crimes effectively,maintain legal order and protect orderly competition.It also helps to carry forward the concept of"non-litigation"in traditional Chinese culture,enhance the"ethical spirit"in the real world,and promote the harmony between individual perfection and overall perfection.
