摘要 通过梳理法国劳动制度的发展历程,本文重新审视了资本主义和雇佣劳动之间的关系。建立在工作租约基础上的经济活动模式促成了法国雇佣劳动的发展,劳动立法应运而生,随之不断完善的社会化的劳动制度推动了法国工业化进程。在信息化、智能化的背景下,共享经济、分享经济方兴未艾,劳动关系正面临全新的挑战。除了顺应新的就业形态,作为经济活动规范性框架的劳动制度更应注重劳动者可行能力的发展,唯有如此,劳动制度才能切实推进各企业、各行业的协同创新,带来社会的全面发展。 Through reviewing the development of French labor regime,this article re-examines the relationship between capitalism and wage labor.The economic activity model based on the lease of work has contributed to the development of wage labor in France.Labor legislation came into being and the labor regime,which is continuous improved and socialized,promoted the process of industrialization in France.In the context of intellectualization and informatization,the sharing economy is in the ascendant,and the labor relation is facing new challenges.In addition to complying with new employment format,as a normative framework for economic activities,the labor system should pay more attention to the development of capability approach of workers.Only in this way,the labor system effectively can promote the collaborative innovation of various enterprises and industries and bring about the overall development of society.
