Legal Risk Prevention of Overseas Nuclear Power Project Contracting

随着中国核电走出去战略的稳步推进,海外核电工程企业面临着越来越多的机遇和挑战。海外核电工程的长期性、复杂性、专业性向核电企业的法律风险防控工作提出了更高的要求。本文从海外核电项目法律工作面临的挑战为切入点,重点分析了海外核电项目在市场准入、采购要求、适用法律、知识产权领域的主要法律风险点,最后从法律风险防控工作常态化、长效化的角度提供了防范建议,为核电走出去的法务工作提供参考借鉴意义。

With the gradual implementation of the going out strategy in nuclear power field,the overseas nuclear power engineering companies in China are facing more and more opportunities and challenges.Because of the long-term nature,complexity,and professionalism of overseas nuclear power projects,it requires a higher standard for the legal work to prevent and control risk.Starting with challenges of the legal work in overseas nuclear power projects,this paper focuses on the main legal risks that may arise in the fields of market access,procurement,applicable laws,and intellectual property rights.From the perspective o£forming a more normalized and efficient legal risk prevention system,this paper proposes a strategy to prevent the legal risks,hoping it can provide reference for the legal work in the process of China's nuclear power going out.
