采矿权勘测定界测量精度研究

摘要 为实现采矿权勘测定界工作科学化、规范化、精准化,研究制定采矿权勘测定界技术规程已刻不容缓。本文基于矿业权“三位一体”权利结构的解析,从准入资质、国土空间管控行政权及资产物权3个维度,梳理了相关技术标准对勘测定界测量精度的规定,确定采矿权勘测定界测量精度应分级规制,不应一刀切。从物权角度探讨了采矿权勘测定界测量精度的决定因素,规定了3个等级采矿权勘测定界测量中误差分别为0.1 m、0.5 m、1.0 m。最后提出了关于矿区范围拐点坐标数值只需保留两位的政策建议。 In order to realize the scientific,standardized,and precise work of surveying and demarcation for mining right,it is urgent to study and formulate the technical regulations of the surveying and demarcation for mining right.The requirements of relevant technical standards on the measurement accuracy of surveying and demarcation from the three dimensions of access qualification,administrative power of land and space control,and property rights are sorted in this study based on the analysis of the“trinity”rights structure of mining rights.The measurement accuracy of surveying and demarcation for mining right should be regulated by grades and should not be one size that fits all.The determinants of the measurement accuracy of surveying and demarcation for mining right are discussed from the perspective of property rights.The errors of the three levels of surveying and demarcation for mining right are specified to be 0.1 m,0.5 m,and 1.0 m.Finally,a policy suggestion is put forward with a point of view that only two digits of the coordinates of the inflection point in the mining area should be retained.
