Research on Expansion and Application of Crime of Obstruction of Public Service in Public Emergency

新冠肺炎期间,刑事司法处于“非常状态”,妨害公务罪更是呈现出扩张适用的趋势。公众心理状态、刑事政策导向、社会整体舆论等原因,使得扩张适用妨害公务罪有其现实必然性。破解此问题,应从“快慢”两方面入手。在快方面,采取快速而精准的措施,引导正向的社会心理,减少不良情绪对矛盾的激化;实现政策与规范的动态平衡,把握罪名扩张适用的限度。在慢方面,注重法治意识的长期培育,为社会舆论注入价值引导,避免司法被重刑主义诉求所裹挟。

During COVID-19,criminal justice is in an abnormal state.The crime of obstructing public service shows a trend of expansion and application.Due to public psychological state,criminal policy orientation,overall public opinion,they makes expansion and application of crime of obstruction of public service,which has existential necessity.Solving the problem,we should start with two aspects:quickly and slowly.In the quick aspect,we should take quick and precise measures.Guide the positive social psychology and reduce the intensification of contradictions by bad emotions.In the slow aspect,we should pay attention to the long term cultivation of legal consciousness,inject value guidance into public opinion and avoid justice being trapped by severe punishment.
