从《唐律疏议·户婚律》探析唐初婚姻观念

Analysis of the Concept of Marriage in Tang Dynasty from the Family Law of the Tang Code

《唐律疏议》作为中国法典史上的耀眼成果,沿袭隋朝律法中原有的法律体系,呈现出封建社会法律的典型性。在《户婚律》这一篇章里,涉及唐代婚姻的各项规定与禁忌。通过分析《唐律疏议·户婚律》,考证唐代婚姻的观念、习俗,探究唐代婚姻律法形成的条件,从中可以看出唐代婚姻观念对社会风气的影响。

As a brilliant achievement in the history of Chinese codes of law,the Tang Code followed the original legal system of Sui Dynasty,presenting the typical features of feudal society law.In the chapter of the Family Law,various regulations and taboos of marriage in Tang Dynasty are involved.By analyzing the Family Law of the Tang Code,this paper examines the concept and customs of marriage and explores the conditions for the formation of marriage law in Tang Dynasty.From this,the influence of the concept of marriage on the social atmosphere can be seen.
