在新的历史起点上推进党内法规评估的法治化新发展

Promote the New Development of the Rule of Law in the Evaluation of Inner-Party Laws and Regulations at a New Historical Starting Point

作为党内法规治理机制的党内法规评估,其法治化可有效提升其服务党内法规建设的系统治理、精准治理和过程治理的效能。学理上,体系法制化和能力法治化是党内法规评估法治化的目标追求,查漏补缺的引领完善、明责督行的规范监督是其法治功能的内核所在。实践中,党内法规评估制度体系尚未健全,制度优势难以转化为推进其法治化发展的效能;基于功能导向的"限权督责、解意询问、查漏补缺"类型重塑能更好地契合新时期党内法规评估能力法治化的现实需求。对此,文章认为通过制度化、规范化结合以完善常态长效机制,责任化、精准化结合以加强监督制约机制,系统化、流程化结合以优化衔接联动机制,体系化、信息化结合以落实跟踪反馈机制,是推进党内法规评估法治化发展的可行路径。

As the inner-Party regulation governance mechanism,the legalization of inner-Party regulation evaluation can effectively improve the effectiveness of system governance,precision governance,and process governance in serving the construction of inner-Party regulations.Theoretically,the legalization of the system and the legalization of the ability are the goal pursuit of the legalization of the evaluation of inner-Party laws and regulations.The core of its rule of law function is the guidance and improvement of leak detection and filling,and the standardized supervision of accountability and supervision.In practice,the evaluation system of inner-Party laws and regulations is not perfect,and the institutional advantages are difficult to be transformed into the effectiveness of promoting the development of the rule of law;the reconstruction of the type of"power limitation and responsibility supervision,interpretation and inquiry,leak detection and vacancy filling"based on the function orientation can better meet the practical needs of the legalization of the evaluation ability of inner-Party laws and regulations in the new era.In this regard,the article believes that the feasible path to promote the development of the rule of law in the evaluation of inner-Party laws and regulations is to improve the normal long-term mechanism through the combination of institutionalization and standardization,strengthen the supervision and restriction mechanism through the combination of accountability and accuracy,optimize the connection and linkage mechanism through the combination of systematization and process,and implement the tracking and feedback mechanism through the combination of systematization and informatization.
