摘要
为了改变生态环境损害救济制度缺失的现状,有必要建立生态环境损害赔偿制度。对于该项制度的构建,主要分为两个方面:在理论方面,对于有争议的地方,应该尽快找出合理方案去解决争议;在实践方面,要总结经验,出台相关的法律和司法解释,使其能够法律化,并应完善相关配套制度,最终构建出全面、系统的生态环境损害赔偿制度体系。
In order to change the lack of the ecological environment damage relief system,it is necessary to construct an ecological environment damage compensation system.The construction of this system is mainly divided into two aspects:in theory,for disputes,we should find a reasonable solution to resolve disputes as soon as possible;in practice,we should summarize experience and issue relevant legal and judicial interpretations.It can be legalized,and related supporting systems should be improved to build a comprehensive and systematic ecological environment damage compensation system in the end.
