论教育法法典化的实践需求与实现路径 被引量:77

On the Practical Demand and Realization Path of Codification of Laws on Education

摘要 现阶段我国教育法体系呈现分散性特征,表现在教育单行法的立法思路和公法私法分立的总体面貌。分散式教育立法造成教育法体系的臃肿化、教育法规范的碎片化和教育法内容的对立冲突等结构性缺陷。教育法法典化可消解教育法律复杂化、促进教育法原则统一、促进教育立法现代化,是教育立法由分散走向体系的理想路径。教育法法典化有着内在动力和外在动因。在编纂思路上,教育法典应当是一部突破公法和私法界线的法律,应当以教育法律关系作为教育法典的编排主线,选择体系型编纂模式,以“总则——分则”建构教育法典内部体系,协调教育法典与司法实践的关系,并实现教育法典与其他社会科学的关系融贯。 At the present stage,the legal system on education in China presents the characteris-tic of piecemeal approach,which is manifested in the legislative thinking of separate laws on educa-tion and the overall appearance of the separation of public and private laws.The piecemeal-approach legislation on education leads to structural defects such as the bloated legal system on education,the fragmentation of legal norms on education and conflicts in content among laws on education.The codification of laws on education can eliminate the complexity of education law,promote the unifi-cation of the principles of education law,and promote the modernization of education legislation,which is the ideal path of education legislation from piecemeal approach to systematic approach.There are internal and external motivations for the codification of laws on education.In terms of the way of thinking on coding,the Education Code should be a law to break through the boundary of public and private laws,with the legal relationship as its coding mainline,by choosing systematic approach as its coding mode and adopt the"general part-specific part"mode to establish its internal.system,thus making coordination between Education Code and judicial practice and realizing coher-ence between the Education Code and other social sciences.
