摘要
就公众环境信息权入环境信息法的议题而言,目前仅有公众环境信息知情权入法,理论上已经证成的公众其他环境信息权并未入法。有必要在探讨已经入法的公众环境信息知情权的赋能不足缺陷的基础上,推动公众其他环境信息权入法的重要价值意义认知,从而形成完整意义上的公众环境信息入法所带来的制度红利探讨命题。就公众环境信息权整体入环境信息法带来的制度红利命题而言,公众环境信息权整体入法不仅是环境信息流“全过程”民主观念的制度性细化落实,还是贯彻执行国家数字经济发展方针政策的微观体现,且能为环境信息质量保障提供更好的制度支撑,可夯实绿色原则实践样态评价反馈所需的信息基础,可筑厚环境多元共治实际效果评价反馈的信息基础。
As far as the discussion of the legalization of the public’s right to environmental information is concerned,currently only the public’s right to be informed of environmental information has been legalized,while other environmental information rights of the public that have been proved in theory have not.It is necessary to promote the recognition of the importance of the value and significance of the legalization of other environmental information rights on the basis of exploring the shortcomings of the legalized part(the right to be informed of environmental information),so as to start the discussion of the institutional dividends brought forth by the legalization of the public’s environmental information as a whole.In this sense,the legalization of public environmental information as a whole secures the democratic concept in the whole process of the environment information flow with detailed institutional regulations,but also presents a microcosmic embodiment of the implementation of the national digital economy development policy,which provides adequate institutional support for environmental information quality,consolidate the information base required for feedback on the evaluation of the practice of green principles,and build the information base for feedback on the evaluation of the actual effect of environmental pluralistic governance.
