摘要
双边市场理论冲击着传统的反垄断法研究框架,四部门约谈蚂蚁集团、市场监管总局对阿里“二选一”等涉嫌垄断行为立案调查、Google案、“3Q”案等互联网反垄断事件案例皆反映出在反垄断实践中,传统的相关市场的界定方法存在困境。本文从互联网双边市场的特性出发,通过互联网的交叉网络外部性的正负性、进一步细分相关市场、改进界定相关市场的技术手段、提出最小产品组合理论来界定市场。
Bilateral market theory impacts the traditional anti-monopoly law research framework.The four departments interviewed Ant Group and the State Administration of Market Supervision on the investigation of suspected monopolistic behaviors such as Ali’s“choose one”and other Internet antitrust cases such as the Google case and the“3Q”case.The incident cases all reflect the dilemma in the traditional method of defining relevant markets in anti-monopoly practices.Starting from the characteristics of the Internet's bilateral market,this article defines the market through the positive and negative nature of the Internet's cross-network externalities,further subdividing the relevant market,improving the technical means of defining the relevant market,and proposing the minimum product portfolio theory.
