摘要 在《印度之行》中,E.M.福斯特围绕阿齐兹的犯罪审判,对英国统治下印度的法庭、法庭审判场景、审判气氛和参与法庭审判的观众、律师和法官等各式人物进行了详细的描写。本文介绍了殖民地时期印度的法律发展历程,探讨了以英国为代表的西方世界对于印度的种族偏见以及在对阿齐兹审判过程中的反映。本文认为,通过对于阿齐兹审判的描写,小说揭示了英国强加于印度的法律制度以及该法律制度与印度本土的法律制度与法律文化的冲突,充分反映了殖民地法律中根深蒂固的种族歧视。 In A Passage to India, E.M.Foster focuses on Dr. Aziz’s criminal trial, and describes the courts, court trials, the atmosphere of the court trials, as well as the audiences, lawyers and judges participating in the court trials. The article introduces the legal development process of India during the colonial period, and discusses the racial prejudice against Indian people in the Western world represented by the United Kingdom which is reflected in the trial of Aziz. The article concludes that by the description of the trial of Aziz, the author exposed the unfairness of the legal system imposed on India by the British and the conflict between this transplanted legal system and culture and the Indian native ones, which has fully reflected the deeply-rooted racial prejudice in the laws of colonial India.
