构建伦理委员会利益冲突回避制度的几点思考

伦理委员会是伦理审查工作的执行机构,为保证审查结果的客观公正,伦理委员会成员在利益冲突时应当回避。然而,我国尚未建立完备的伦理委员会利益冲突回避制度,利益冲突回避原则适用存在诸多问题。一方面,适用主体范围局限,回避事由不够全面,回避程序不够清晰。另一方面,法律规范位阶较低,司法救济程序缺位,行政监管难以落实。针对以上问题,建议参考我国程序法的相关规定,构建一套完备的伦理委员会利益冲突回避制度,确保审查结果公正,进而保障受试者的健康安全。

The ethics committee is the executive body of the ethical review work.In order to ensure the objective fairness of the review results,the ethics committee members should avoid the conflict of interest.However,China has not yet established a complete conflict of interest avoidance system for the ethics committee,and there are many problems in the application of the principle of conflict of interest avoidance.On the one hand,the scope of the application subject is limited,the avoidance reason is not comprehensive enough,and the avoidance procedure is not clear enough.On the other hand,there are the low level of legal norms,the absence of judicial relief procedures,and difficult to implement administrative supervision.In view of the above problems,it is suggested to build a complete system of conflict of interest avoidance of the ethics committee in accordance with the relevant provisions of China’s Procedure Law,so as to ensure that the examination results are fair and thus ensure the health and safety of the subjects.
