涉案电磁波的物证特性分析

摘要 在介绍涉案电磁波的分类及其产生和作用模型的基础上,分析涉案电磁波作为物证的基本条件、所属的物证类型以及物证表现形式。分析结果表明:涉案电磁波满足作为物证所需的关联性和可用性条件,可以看作是具有一定形状、能发挥实际涉案作用的电子物品,它同时属于物质属性物证、存在状况物证和理论上的外部特征物证,其物证表现形式相当多样。 Based on the introducing the classification of the crime-related electromagnetic waves and their generation-and-effect models,the basic conditions of the crime-related electromagnetic waves as physical evidence were firstly analyzed,then the physical evidence types of the crime-related electromagnetic waves as physical evidence were analyzed,and finally the expressive forms of the crime-related electromagnetic waves as physical evidence were finally analyzed.Analysis results show that:the crime-related electromagnetic wave meets the requirements of relevance and availability as physical evidence,it can be regarded as an electronic article with a certain shape and can play an actual role in the case,it belongs to material attribute evidence,existence evidence and theoretical external characteristic evidence,and its expressive forms of physical evidence are quite diverse.
