Analysis of the Synergistic Mechanism of Environmental Justice and Administrative Law Enforcement in Rural Eco-environmental Governance

环境行政执法在农村生态环境治理中的重要性毋庸置疑,但作为后起之秀的环境司法的贡献也功不可没,社会转型时期多元共治协同治理之生态保护模式是对当下农村生态环境保护问题的及时性回应。建立环境司法与行政执法协同机制是塑造农村生态环境治理体系和推动其治理有效的重要举措。但在当下的农村生态环境治理过程中,环境司法与行政执法协同机制的建立却面临着权力行使的结构性障碍、行为理念与机制的矛盾及信息沟通不畅等现实窘境,故须在尊重行政执法的初始职权、发挥环境司法的监督职权、整合环境治理主体的多维保护功能的基本原则下,优化结构,构建诉前行政机关预警与环境司法监督的机制;调和矛盾,构建诉中协同证据转化与协助鉴定的机制;加强沟通,构建判决执行信息共享与司法成果转化的机制。

While the importance of administrative environmental law enforcement in rural eco-environmental governance is undeniable,the contribution of environmental justice,as a latecomer,is also significant. The ecological protection model of multiple governance and collaborative management during social transformation is a timely response to the current problems of rural ecological protection. The establishment of a synergistic mechanism between environmental justice and administrative law enforcement is an important step in shaping the rural eco-environmental governance system and promoting its effective governance. However,the establishment of the synergistic mechanism between environmental justice and administrative law enforcement in the process of rural eco-environmental governance is faced with structural barriers to the exercise of power,contradictions between the concept of behavior and mechanism,and poor information communication,so the structure must be optimized in the basic principles of respecting the initial authority of administrative law enforcement,playing the supervisory authority of environmental justice,and integrating the multi-dimensional and three-dimensional protection functions of environmental governance subjects,and building a prelitigation mechanism of early warning of administrative organs and environmental judicial supervision;reconciliation of contradictions,construction of the mechanism of collaborative evidence transformation and assistance in identification;strengthening communication,construction of information sharing and judicial results transformation mechanism of judgment implementation.
