摘要
分析不同类型专利权人的专利失效影响因素,为专利维持时间和失效风险的预测提供依据。选择江苏省2010年申请并获得授权的发明专利作为研究对象,划分为个人组、院校组和企业组,以专利失效为结局变量,采用多因素COX回归模型分析不同组专利失效的影响因素。研究表明,企业组专利有效率明显高于个人组和院校组,多因素COX回归结果显示审查周期是3组专利失效的保护因素,延伸申请是个人组和院校组专利失效的保护因素,是企业组专利失效的危险因素。不同类型专利权人的专利失效影响因素存在显著差异。
This paper analyzed the influencing factors of patent failure of different types of patentees to provide a basis for the prediction of patent maintenance time and failure risk.The invention patents applied for and granted in Jiangsu Province in 2010 were selected as the research objects,divided into individual group,institution group and enterprise group,and the influencing factors of patent failure in different groups were analyzed by multi-factor COX regression model with patent failure as the ending variable.The patent efficiency rate of the enterprise group was significantly higher than that of the individual group and the institution group.The multi-factor COX regression results showed that the examination period was a protective factor for patent failure in the three groups;the extension application was a protective factor for patent failure in the individual group and the institution group,and a risk factor for patent failure in the enterprise group.There were significant differences in the factors influencing patent failure among different types of patentees.
