少数民族地区智慧法院建设的理论基础与实践路径

On the Theoretical Basis and Practical Path of the Construction of Smart Court in Areas of Ethnic Minorities

少数民族地区智慧法院建设已经展开广泛实践并取得阶段性成果,但仍然存在信息化和智能化水平偏低、应用系统本地化程度不足、数据汇集和利用不充分、复合型人才缺失等问题。应通过智慧法院建设服务少数民族群众、回应少数民族地区司法的个性化需求、提升少数民族地区的司法能力、助力少数民族地区民族间法文化的融合。少数民族地区开展智慧法院建设,需要在尊重当地的风俗习惯和司法特性的前提下,从基础建设、规划设计、民族关照、协同治理、法治建设等五个方面进行总体构想和实践探索。

The construction of smart court in areas of ethnic minorities has been under way and achieved initial results,but there are still some problems,such as low level of informatization and intelligence,insufficient localization of application system,low utilization rate of data,lack of interdisciplinary talents and so on.Through the construction of smart court,we should serve the people of ethnic minorities,respond to the personalized needs of judiciary in areas of ethnic minorities,enhance the judicial capabilities in areas of ethnic minorities and facilitate the integration of legal culture among ethnic groups in areas of ethnic minorities.To carry out the construction of smart court in areas of ethnic minorities,overall design and practical exploration should be carried out from the five aspects on the basis of respecting the local customs and judicial characteristics in areas of ethnic minorities,namely,infrastructure construction,unified layout,ethnic care,collaborative governance,and the construction of the rule of law.
