我国未成年人社区矫正工作的执行现状及推进路径——以我国社区矫正法相关规定为切入

The Implementation Status and Promotion Path of Juvenile Community Correction in China:Based on the Relevant Provisions of Community Correction Law

未成年人是服刑人员中的特殊群体,是社区矫正的重点适用对象。减少监禁损害,加强社会联结是未成年人社区矫正工作的价值所在。然而,非监禁化的司法保护原则未有效贯彻、专门性的矫正项目缺少、专业化的工作队伍缺乏,严重掣肘未成年人社区矫正工作的深化发展。适用比例不高、区分程度不够、矫正措施不精是其困境表征。为充分发挥社区矫正改造未成年人的优势,需要减少未成年人监禁刑罚适用,减短监禁期限;落实区别对待原则,设计符合未成年人的矫正项目;提升工作队伍的专业化技能,提高矫正措施的精细化水平。

The juvenile offender is a special group among the prisoners,and is the key object of community correction.The value of community correction for juvenile offenders lies in reducing the damage of imprisonment and accelerating the return to the society.However,the non-custodial judicial protection principle has not been effectively implemented,the lack of specialized correction projects,and the lack of professional work teams have severely hindered the in-depth development of community correction for minors.The low proportion of application and the bad degree of differentiation are its predicaments.In order to give full play to the advantages of community correction,we need to reduce the application of juvenile imprisonment penalty and shorten the term of imprisonment;Implement the principle of differential treatment and design correction projects that meet the needs of minors;Improve the professional skills of the working team,improve the refinement level of corrective measures.
