On Legalization of Full Altruistic Surrogacy between Collateral Blood Relatives in Three Generations

以三代内旁系血亲完全且利他代孕为论证对象,对代孕均应当绝对禁止学说理由的缺陷进行批判性分析。三代内旁系血亲完全且利他代孕具有理论上的正当性和实践操作上的可行性,我国应当通过制度设计规避其道德滑坡的风险,保障代孕始终运行在正确的轨道上。在《母婴保健法》修订或“人类辅助生殖技术法”制定中,融入严厉打击非法代孕原则公立医疗机构特许技术垄断原则、公权力全流程介入监管原则和代孕子女亲权司法最终裁决权原则四项基本的管制原则。

This article takes full altruistic surrogacy between collateral blood relatives in three generations as the demonstration object,and makes a critical analysis on the defects of the reasons that surrogacy should be absolutely prohibited.The full altruistic surrogacy between collateral blood relatives in three generations has legitimacy in theory and feasibility in practice.It needs to avoid the risk of moral decline through system design in China and ensure that the legalization of full altruistic surrogacy always runs on the right track.It is suggested to integrate four basic regulatory principles which are cracking down on illegal surrogacy,monopoly of licensed technology of public medical institutions,whole process intervention and supervision of public power and final adjudication of surrogate children's parental power into the revision of the Law on Maternal and Infant Health Care or the Law on Human Assisted Reproductive Technology.
