换位意识对法治中国建设的意义

The Significance of Transposition Consciousness to the Construction of China under the Rule of Law

换位意识是人际交往的黄金规则,它植根于人的自然性、社会性和政治性。换位意识内在地包含着民主、限权、人权、平等、正义等价值,对法治中国建设具有重要意义。实际上,换位意识的培育和践行面临障碍,法治中国建设也遭遇阻力。立足法治工作的基本格局,将换位意识融入立法、执法、司法和守法诸环节,将有力推进法治中国建设。换位意识融入法治系统的限度是,不得损害法律权威,不得公权私用,不得私自动用暴力,不得设置过高的行为标准。

Transposition consciousness is the golden rule of interpersonal communication.It is rooted in human nature,sociality and politics.Transposition consciousness inherently contains the values of democracy,power limitation,human rights,equality and justice,which is of great significance to the construction of China under the rule of law.In fact,the cultivation and practice of transposition consciousness are facing obstacles,and the construction of China under the rule of law is also facing obstacles.Based on the basic pattern of the rule of law,integrating the transposition consciousness into the links of legislation,law enforcement,judicature and law-abiding will effectively promote the construction of China under the rule of law.The limit of transposition consciousness into the rule of law system is not to damage the legal authority,not to use public power for private use,not to use violence without permission,and not to set too high standards of behavior.
