新《民促法》下独立学院转设逻辑与法理分析

Logic and Jurisprudential Analysis of the Transformation of Independent Colleges under the New Civil Education Promote Law

新修订的《中华人民共和国民办教育促进法》《中华人民共和国民办教育促进法实施条例》以及《关于加快推进独立学院转设工作的实施方案》等文件提出了对独立学院转设的规范与要求。独立学院转设既存在客观动因、也有主观需求,在转设过程中需要遵守政府逻辑、市场逻辑、高等教育逻辑等多重逻辑;转设路径主要有转为公办、转为民办、终止办学等;新民促法等法律法规也从分类管理、土地产权、关联交易等方面对独立学院转设后发展进行了法律规制。

There are both objective motives and subjective needs for the transfer of independent colleges.In the process of transfer,we need to abide by multiple institutional logic such as government logic,market logic and higher education logic.The transfer paths mainly include turning to public,turning to private,termination of school,etc.Laws and regulations such as the new civil promotion law also regulate the development of independent colleges from the aspects of classified management,land property rights and related party transactions.
