《排污许可管理条例》与相关环境管理法律制度衔接的研究分析

Analysis on the connection between the Regulation on the Administration of Pollutant Discharge Permits and the relevant environmental management legal systems

当前《排污许可管理条例》进入实施阶段,标志着排污许可制四梁八柱基本建成。但是,以排污许可制为核心的固定污染源监管制度体系尚未健全。本研究对比分析《排污许可管理条例》与相关环境管理法律法规及政策等,重点识别衔接问题,并在此基础上提出如下建议:重点推动环保专项法修订,进一步夯实排污许可法律基础;聚焦《排污许可管理条例》实施,完善排污许可制度体系;健全政策体系,着力推动排污许可制度与其他环境管理制度衔接融合。

At present,the Regulation on the Administration of Pollutant Discharge Permits comes into enforcement,which marks the completion of the four beams and eight pillars of the pollution discharge permit system.However,the regulation system of fixed pollution sources with pollutant discharge permit system as the core has not been perfected yet.This study compares and analyzes the Regulation on the Administration of Pollutant Discharge Permits and related environmental management laws,regulations and policies,focuses on identifying the convergence issues,and on this basis,puts forward relevant suggestions:focus on promoting the revision of special laws on environmental protection,to further consolidate the legal basis of pollutant discharge permits;focus on the implementation of the Regulation on the Administration of Pollutant Discharge Permits,to improve the management system of pollutant discharge permits;work hard to improve the policy system,and strive to promote the integration of the pollutant discharge permit system with other environmental management systems.
