On the Comparative Teaching Method of Criminal Law Theory

外国刑法理论对我国刑法学有着重要的借鉴意义,因此,在进行刑法理论教学时应当注重比较教学方法。在进行外国刑法理论的比较教学时,首先,应当进行比较原理的教学,包括比较的目的、前提与背景等;其次,展开具体外国刑法理论的背景及内容介绍,同时分析该外国刑法理论对我国的意义及在我国的适用问题;最后,进一步探讨如何对外国刑法理论进行推进与优化,也即在借鉴外国刑法理论的同时结合我国的实际情况对其进行一定的理论创新。

Foreign criminal law theories are of great significance to our criminal law.Therefore,in the teaching of criminal law theories,comparative teaching methods should be paid attention to.In the comparative teaching of foreign criminal law theories,firstly,the comparative principles should be taught,including the purpose,premise and background of comparison.Secondly,teachers can introduce the significance and application of foreign criminal law theories in China.Finally,this paper further explores how to promote and optimize foreign criminal law theories and combine them with the actual situation of our country.
