摘要
网络外卖食品管理法律主体责任界定不明确,导致食品安全性得不到保障。为此,有必要进行网络外卖食品安全管理法律主体责任界定,以规范外卖市场。利用关联分析法选取网络外卖食品安全管理法律主体,包括商家、供应商、外卖订餐平台、政府监管部门、媒体等;利用文献分析法、事故案例分析法及专家访谈法,总结各方主体行为对食品安全的影响因素;在获取问卷调查数据基础上,结合主成分分析法,明确各方主体对对食品安全的影响程度,完成外卖食品安全法律主体责任界定。界定结果表明,对于食品安全的影响程度:商家>供应商>政府监管部门>外卖订餐平台>媒体。通过研究以期提高网络外卖食品安全性,促进外卖行业健康发展。
The legal subject responsibility definition of online takeaway food management is not clear, which leads that food safety can not be guaranteed. Therefore, it is necessary to define the legal subject responsibility of network takeout food safety management to standardize the takeout market. The correlation analysis method is used to select the legal subjects of network takeout food safety management, including businesses, suppliers, takeout ordering platform, government regulatory departments,media, etc. By using the methods of literature analysis, accident case analysis and expert interview, summarize the influencing factors of each party’s behavior on food safety. On the basis of obtaining the questionnaire survey data, combining with the main body component analysis method, clear the impact of the parties on food safety, and complete the legal responsibility of takeaway food safety. The results show that the impact on food safety is as follows: business>supplier>government regulatory department>takeout ordering platform>media. It is hoped to improve the safety of online takeaway food and promote the healthy development of takeaway industry.
