Police Civil Mediator in the New Period:Importance,Challenges,and Proposals to Change

在当前“大调解”社会纠纷综合治理背景下,公安机关参与调处民事纠纷具有重要意义。警察职能定位、警务模式选择、警务资源配置、警察绩效考核机制、警察专业化和规范化建设要求等,对警察民事调解都提出了诸多挑战。本文从立法、人才培养和制度建设三个方面提出了建议:立法上,明确警察民事调解规范;人才培养源头上,公安院校应在本科教育中开设“警察民事调解训练”相关课程并加强在职警察民事调解培训;在制度建设上加强警察民事调解与人民调解、司法有机结合。

In the context of the application of the mass mediation dealing with social disputes for the comprehensive management,police dealing with civil disputes has of great importance.However,there are challenges in police in civil mediation because of duty orientation of police,policing model,allocation of policing resources,evaluation mechanism of police achievement,and requirements for professionalism and normalization.This paper proposes that legal regula-tion should be made to stipulate the role of police in civil disputes and the courses about the police as mediator in civil disputes should be provided to the cadets in police academy,the training should be accommodated to the police practitioners to integrate the mediation in the process of law enforcement,and police civil mediation,people mediation and court mediation should be streamlined.
