摘要
行政案件快速办理程序规定是参照刑事案件速裁程序规定颁行的,二者既在制度设置理念、价值、前提和实施效果方面存在相同之处,又在参与主体、受益主体、各自法律体系的地位等方面存在质的差异。与刑事速裁一样,快办程序也存在办案人员可能滥用职权、欠缺有效的第三方参与、协商的自愿与平等性无从保障和流于形式的程序“把关者”等缺陷。建议通过扩大简易程序适用范围、引入值班律师制度、确立认错认罚具结书制度、规定行政处罚一决制、完善程序回转机制等进一步完善快办程序,使快办程序真正成为独立的行政处罚程序。
The rapid handling procedure of administrative cases and criminal rapid adjudication procedure are promulgated one after another,they both have similarities on the dea,value,premise,effect of establishing system,and have qualitative differences on participants,beneficiary,respective status of their legal system.The rapid handling procedure,like rapid criminal adjudication,exist many defects including investigators abusing their power,being lack in effective third party participation,no way for guaranteeing voluntariness and equality of consultation,mere formality procedure“gatekeepers”.As a result,we suggest that the rapid handling procedure should be further improved through expanding application scope of the summary procedure,importing duty counsel system,establishing the affidavit of admitting mistakes and admit punishment system,setting one-final adjudication system for administrative sanction,improving the mechanism of procedure rotation,and then will become one kind of independent procedure.
