摘要
法治思维源于人们在生活实践中对规则和秩序的理性追求,它为爱国主义教育克服情感至上的行动思路提供了借鉴框架。爱国主义教育需要用法治思维进行法律制约,需要以法治思维克服认知障碍,需要借法治思维摆脱行为羁绊。法治思维以规则意识的客观化反思、程序意识的合法性判断、理性意识的权利式保障,彰显着它在爱国主义教育中的理论特质。立足法治思维阐释爱国主义教育的现实意义、遵照法治思维创新爱国主义教育的时代内容、依据法治思维探寻爱国主义教育的方法运用,是法治思维对爱国主义教育的实践规定。
Rule of law mindset stems from rational pursuit of rules and order in people’s daily lives,which can serve as reference framework for patriotic education to overcome being overly sensational.The patriotic education needs to be regulated with legal framework to overcome cognitive barriers with rule of law and to break away from practical hurdle with the mindset.The mindset highlights its theoretically feature in patriotic education through objective reflection based on rules awareness,legality judgment of procedure and right protection deriving from rationality.Relying on rule of law to interpret realistic significance of patriotic education,innovating patriotic education in a new era bases on rule of law,and exploring uses of patriotic education from rule of law perspective offers practical framework for patriotic education.
