自然资源领域行政非诉执行监督实务研究——以非法占地类行政处罚为例

Supervision Practice of Administrative Non-litigation Execution in the Field of Natural Resources——The Case of Administrative Penalties of Illegal Land Occupation

自然资源部门一般依《土地管理法》对非法占地类违法建筑作出罚款和责令限期拆除的行政处罚。行政相对人拒不履行限期拆除的处罚决定的,自然资源部门需依法申请人民法院强制执行,即行政非诉执行。以检察监督为视角,提出规范此类行政非诉执行的申请程序、加强社会稳定风险控制、明确行政非诉执行的责任主体,同时充分发挥检察监督职能,探索非法占地类行政非诉执行积案清理的新机制、明确非诉执行的受理和审查标准等意见建议。充分发挥行政检察“一手托两家”—既促进依法行政又监督公正司法的作用,共同破解非法占地类违法建筑行政处罚的执行难题。

The natural resources department generally imposes fines and orders for demolition on illegal construction of illegal land occupation within a time limit in accordance with the Land Management Law.If the administrative counterpart refuses to implement the penalty decision on demolition within a time limit,the natural resources department shall apply to the people's court for compulsory execution according to law,namely,the administrative non-litigation enforcement.This survey is based on the perspective of procuratorial supervision,then put forward that the department concerned can standardize the application procedures for such administrative non-litigation enforcement,strengthen social stability risk control,and clarify the responsible subject of administrative non-litigation enforcement,at the same time giving the full play to the procuratorial supervision function.The paper also ensure a new mechanism for clearing up backlogs of administrative non-lawsuit enforcement of illegal land occupation,clarify the acceptance and review standards for non-litigation enforcement and so on.Thus,it will give full play to the role of administrative procuratorial“supporting two with one hand”—both supporting administration according to law and supervising fair justice as well as jointly solving the problem of enforcement of administrative penalties for illegal construction of illegal land occupation.
