《黄河法》制度体系设计论纲

Outline of System Design of Yellow River Law

为将黄河流域生态保护和高质量发展纳入法治轨道,实现黄河治理的良法善治,科学有序地开展《黄河法》的立法工作是必然要求。以《黄河法》制度体系设计的理想图景为出发点,探究《黄河法》制度体系设计的逻辑进路和框架构造。《黄河法》的制度体系设计应遵循"从基本理念出发、到基本目标明确、再到基本原则清楚,最后到基本规则确定"的逻辑进路。《黄河法》的制度体系设计应该重点围绕全流域监督管理制度群、开发利用保护制度群、生态环境修复制度群、水旱灾害防御制度群、高质量发展制度群、水污染防治制度群、法律责任制度群等7个部分系统展开,从而完成制度群的框架构造。

In order to bring the ecological protection and high-quality development of the Yellow River Basin into the track of the rule of law,and realize the good law and good governance of the Yellow River,it is an inevitable requirement to carry out the legislation work of the Yellow River Law scientifically and orderly.At present,the legislative work of the Yellow River Law has an urgent need for the systematization of institutional norms,and the basic theoretical discussion of the system design of the Yellow River Law is at the right time.Taking the ideal picture of the Yellow River Law institutional system design as a starting point,it explored the logical approach and frame structure of the Yellow River Law institutional system design.The design of the system of the Yellow River Law should need to follow the logical approach of“starting from basic concepts,to clear basic goals,then to clear basic principles,and finally to the determination of basic rules”.The system design of the Yellow River Law should focus on the whole the development of seven partial systems,including the river basin supervision and management system group,the development and utilization protection system group,the ecological environment restoration system group,the flood and drought disaster prevention system group,the high-quality development system group,the water pollution prevention system group,and the legal responsibility system group.
