基于多方安全计算的电子合同平台的设计与实现

摘要 日常工作中通过快递签署合同的方式,由于存在着无法确定签字盖章的真实性可能造成的法律风险、纸质合同快递物理流转过程中可能造成的商业秘密泄漏风险以及企业内部信息系统(如OA系统)审核后对纸质合同内容的复核所造成的工作效率的浪费,这三个显著问题,使得纸质合同向电子合同的转换成为企业经营中的必然,但合同有其固有的法律属性需求,如何在电子合同平台设计中满足合同基本法律属性的需求,成为电子合同平台设计过程中的挑战。 In daily work,the way of signing a contract by express delivery has legal risks possibly due to the inability to determine the authenticity of the signature and seal,the risk of business secret leakage possibly due to the physical circulation of paper contracts via express,and the waste of work efficiency caused by the review of the paper contract content after the audit by the internal information system of the enterprise(such as OA system).These three significant problems make the conversion from paper contracts to electronic contracts an inevitable trend in business operations,but contracts have inherent legal attribute demand,and how to meet the basic legal attribute demands of the contract in the design of the electronic contract platform has become a challenge for the design of the electronic contract platform.
