《洗冤集录》蕴含的法律思想与现代启示

Legal Thoughts and Modern Enlightenment Contained in Xi Yuan Ji Lu

近代以来,许多学者从法医学和法医技术的角度对《洗冤集录》进行评价,却忽视了其重要的“内核”——宋慈洗冤泽物的法律思想。《洗冤集录》之所以能传承至今,不仅在于其法医学上的“术”,更在于其体现出来的法律思想上的“道”。在《洗冤集录》的字里行间,明显表现出宋慈“慎刑恤狱”“礼法并用”和重视客观证据的法律思想。《洗冤集录》绝非单纯的法医学著作,其所蕴含的鲜明的法律思想,亦超出了法医学的范围,而应该上升到法学、乃至法治的高度,对我国法治社会的建设具有重要的借鉴和启示意义。

Since modern times,many scholars have evaluated the book Xi Yuan Ji Lu from the perspective of forensic science and forensic technology,but have neglected its important“core”-Song Ci’s legal thoughts to rectify injustice.Xi Yuan Ji Lu has been handed down to this day,not only because of its“methods”in forensic science,but also because of its“rules”in legal thoughts.Be-tween the lines of the book,Song Ci’s legal thoughts of“prudent punishment and compassionate im-prisonment”,“combination of the rule of rites and the rule of law”and emphasis on objective evi-dence are clearly shown.Xi Yuan Ji Lu is by no means a simple work of forensic science.Its dis-tinctive legal thoughts go beyond the scope of forensic science,and should be elevated to the height of jurisprudence and even the rule of law,which offer important reference and enlightenment to the construction of the law-based society in China.
