中国法英文硕士培养机制的目标背离及其改进

摘要 自2005年以来,中国法英文硕士教育已经具有16年的历史,积累了一定的经验,但也在现实中存在很多问题。中国法英文硕士项目以培养具备解决跨国纠纷的法律工作者为目标,但现行体系存在与培养目标背离的情形。为了使中国法英文硕士教育更好地满足学生的需求,实现培养目标,提升培养效果,需要采取若干改进措施。首先,严格筛选条件,提升准入门槛。其次,增强教师队伍的英语能力。再次,将中国本土学生引入中国法英文硕士教育课堂,与中国法律文化环境衔接。最后,增设法律文书写作课程,培养实践能力,并设置专门化教学,提高专业水平。 Since 2005,the Master of Laws Program in Chinese Law has a history of 16 years and has accumulated a certain amount of experience,but there are also many problems in reality.The program aims to train legal professionals who can resolve transnational disputes.However,the current system deviates from the training goals.In order to better meet the needs of students and achieve the cultivation objectives,the author of this paper asserts that the strengthening of the screening conditions can be adopted.The teaching staff's English capability should be improved.The Chinese legal culture and Chinese students should be imported into classroom.The course of legal document writing should be added to improve students'practical abilities.The teaching methodologies should be specialized and improved.
