数据要素跨境流动与治理机制设计--基于粤港澳大湾区建设的视角 被引量:9

Cross-border Data Element Flow and Governance Mechanism Design:A Perspective Based on the Construction of Guangdong-Hong Kong-Macao Greater Bay Area

摘要 数字经济时代,跨境数据要素流动需要配套合理的治理机制。粤港澳大湾区以其不可替代的特殊性,提供了良好的测试平台,能够为中国乃至全球提供可参照的治理方案。文章对欧盟、美国和其他治理体系的演进归纳借鉴,针对大湾区的特征,分析了大湾区面对的"三元悖论"难题,讨论了大湾区在技术支撑、平台建设、场景应用、监管机制等方面存在的制约,并结合跨境数据生命周期提出"四个维度、五个方面"的原则框架。文章明确了强化技术支撑、加强平台建设、创新场景应用、优化监管机制四条优化路径,为大湾区的数据跨境流动机制设计提供了理论依据。 In the age of digital economy,cross-border data element flow requires reasonable governance mechanism.With its irreplaceable particularity,Guangdong-Hong Kong-Macao Greater Bay Area(GBA)can provide referential governance solutions for China and even the world as a good testing platform.This paper summarizes the evolution of the governance systems of the European Union and the United States as well as other governance systems,analyzes the problem of"the Impossible Trinity"faced by GBA according to the characteristics of GBA,discusses the constraints of GBA existing in technical support,platform construction,scenario application and supervision mechanism,and puts forward the principle framework of"four dimensions and five aspects"combined with the life cycle of cross-border data.The paper defines four optimization paths of strengthening technical support,enhancing platform construction,innovating scenario application and optimizing supervision mechanism so as to provide the theoretical foundation for the design of cross-border data flow mechanism of GBA.
